Terms of Service
Effective Date: January 1, 2026
These Terms of Service ("Terms") govern your use of the ForgingApps website (forgingapps.com) and our development and consulting services. By using our website or engaging our services, you agree to these Terms.
Services
ForgingApps provides custom software development, AI consulting, and ongoing support services as described on our website. All projects are governed by individual project agreements that specify scope, timeline, deliverables, and payment terms.
Project Agreements
Each project requires a separate written agreement. Project agreements take precedence over these general Terms where they conflict. Changes to project scope require written agreement from both parties and may affect pricing and timeline.
Payment Terms
Spark & Ember: 100% upfront. Anvil: 50% upfront / 50% on delivery. Forge: 40% upfront / 30% at midpoint / 30% on delivery. Oracle (hourly): billed weekly. Hearthstone: monthly prepaid, auto-renew. Annual plan: pay 10 months, get 12. Late payments may incur interest at 1.5% per month.
Intellectual Property
Upon full payment, you own all custom code, designs, and assets created specifically for your project. We retain the right to use general techniques, tools, and frameworks developed during the project. We may reference the project in our portfolio unless you request otherwise in writing.
Post-Launch Support
All projects include post-launch support (30 days for Spark, Ember & Anvil; 60 days for Forge). This covers defects in functionality as defined in the project agreement. It does not cover issues caused by third-party services, hosting environments, or modifications made by others.
Limitation of Liability
Our total liability is limited to the amount paid for the specific project or service in question. We are not liable for indirect, incidental, or consequential damages.
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the project. This obligation survives the termination of any agreement.
Termination
Either party may terminate a project agreement with 14 days written notice. Upon termination, you pay for all work completed to date. We deliver all work completed up to the termination date.
Governing Law
These Terms are governed by the laws of the Republic of Bulgaria. Any disputes shall be resolved in the courts of Sofia, Bulgaria.
